You can never permanently delete your account

You can never permanently delete your account but only deactivate it. Is this even legal ?

When i try to delete my account, there is a tab which says deactivate your account and when you click on it there is a message prompt do you want to permanently delete your account? However, once you delete it, you can log back in and it recovers all your information. Long story short the app never deletes your account just deactivates it. This is so unethical. I should file a legal action - users should have the right to chose between deletion and deactivation.
